Question:  

My husband moved down to the states where I lived. We are finding it hard to keep his bills paid up there. Is it possible to file personal bankruptcy from the States or does he have to return to Canada to file?

Answer:   To make an assignment into bankruptcy in Canada you must meet with a Trustee face-to-face, so your husband would have to return to Canada to sign papers. The length of time since he has lived in Canada may also affect whether or not he can file, if it has been more than one year.
