I am considering a joint bankruptcy with my husband and I am confused as to whether this bankruptcy would release us from the Student Loan debt that is going to start payments in March? I have Canada and Alberta student loans totalling about $32000.

Answer:  

If you have left school within the last ten years, your student loan debt will survive if you file bankrutpcy. Unfortunately, there are not a lot of options with respect to this debt. If you are in Alberta you can look at the Orderly Payment of Debt Program. A couple of other provinces also have this program which allows you to stretch payment over 8 years.

To obtain a free assessment regarding your options, you should contact a Trustee in your area by looking in the yellow pages under "Bankruptcy".
