Question:   A business failure will probably force me but not my wife into bankruptcy. The MasterCard is only in my name but they also issued a card to her. The Visa is in joint names. Will she be pulled into the bankruptcy as well?

Answer:

If an individual is a joint card holder or has a second card, they have accepted full responsibility and will have to pay the debt if the other party files bankruptcy. They have the option of also filing bankruptcy, but are not automatically pulled into your bankruptcy.

You should contact Trustee in your area by looking in the yellow pages under "Bankruptcy" to obtain a free assessment of your financial situation.
