Question:  

We have a mortgage on a house in Kitimat BC which we still owe $80000 on. We left Kitimat to another community in BC. We put the house up for sale and even had it rented out for the first few years. But then our tenants moved out,leaving the house in a mess,and with no one to rent it.We managed to pay the mortgage on it for several months but then things started getting tight(financially).

We asked the bank to take the house back, but they refused. What I would like to know is can we declare bankruptcy on just the mortgage or do we have to do it for all creditors.

Answer:  

Bankruptcy is declared on all debts. You cannot pick and choose which ones to include as to do so is an offence.
