Question:  

Moving to Central America in February to be with my fiancee, what is the procedure should I declare bankcruptcy from there as opposed to here? How would I do it? My fiancee and I share two credit cards, but he has never worked in Canada nor has steady employment. If I get his name off the cards before I declare bankruptcy, will they still go after him?

I owe my parents $17000 and they cannot know about my bankruptcy. I wanted to pay them from abroad monthly through a third party. Will this be a problem?

Answer:   If your debt is Canadian you will want to file in Canada. Filing in Central America, if the process is even available, will not help you if you return to Canada in the future.

If you can remove your fiancé's name from the cards they will not be able to pursue him. However, if they won't remove his name they will have recourse to pursue him if they wish. whether they will in Central America is their decision.

When filing bankruptcy, all debt, including relatives and friends should be included as they are a creditor. Payments to you parents during the bankruptcy should be discussed with your Trustee.
