Question:

I am in need of filing for bankruptcy. I have a financial agreement on a 5-ton truck that is NOT in arrears and is in good standing. The rest of my debts are a different story. Can I still file for bankruptcy and keep this financial agreement going or do I have to declare it for some reason? I'd like to get this chapter of my life closed and move on. Thank you. Also thank you for spending your time in maintaining this forum and answering questions.

Answer:

Normally a contract with a secured creditor can continue once bankruptcy is filed. Payments must be up to date when you file and the creditor must agree to let you keep the truck.

The only creditors at the moment who you first must ask permission are the Royal Bank and Bank of Nova Scotia.
