Question:  

I am presently living in Alberta. I have been contacted by a collection agency in New Brunswick stating that the payments that I make each month are not enough to cover my $10,000 student loan, (I am sending $50 a month until I can provide more). I have explained to them that I can't send any more than that and they said that they will transfer my collection loan in Alberta, serve me with papers, bring me to court so that way they will be able to garnish my pay. I am pretty much in the hole and was thinking of filing bankruptcy on everything...I started university in 92-94 and then college 95-97. If I file bankruptcy, can they be included?

Answer:   In a bankruptcy, student loans must be disclosed as a debt but they will not be discharged unless you finished school more than 10 years ago. You will still be liable to pay your student loans once the bankruptcy is complete. You may want to contact Credit Counselling Services of Alberta at www.creditcounselling.com about the Orderly Payment of Debt program, as they can help you with student loan debt.
