Question:   I have been unemployed for about 3 months. My bills have fallen behind and I was thinking about declaring bankruptcy. What happens to my car which I am currently still paying off? Can they take that away from me? Also, what is the difference between chapter 7 and chapter 13?

Answer:  

Chapter 7 & 13 are US terms. In Canada, you would be looking at bankruptcy or a proposal. With respect to your vehicle, a secured creditor is not affected by the bankruptcy and they can either take the vehicle or allow you to continue to make payments. You should contact a Trustee in your area to attend a free assessment of your financial situation.
