Question:  

I have been a resident of Alberta since 1989 and in Feb of this year moved to the USA. Since being there I have been unable to secure a work visa and so my debt load is climbing and climbing. I have just married and filed for immigration papers for US. I have credit card debt and a car loan and am unable to make payments now. What are my options?

Answer:   Your options depend on the size of your debts and your payment ability over the next few months or years and include paying your debts, having a third party pay them for you, doing an informal or formal settlement with the creditors or filing a personal bankruptcy. If you have been out of the country for less than one year a bankruptcy could be filed in Canada, usually with a Trustee in your former home town. You would be required to come to Canada to meet with the Trustee but the remainder of the duties could be dealt with from the U.S. The assets you would be allowed to keep would depend on exemptions available in the U.S. State where you now live.
