Question:  

Can income tax returns be held, if all of the commitments have been met (payments all made to date), but the individual has not been released as yet?

Answer:  

Tax refunds for years up to and including the year the bankruptcy is filed are considered to be assets of the estate and must be paid to the Trustee.
