My spouse and I are considering banruptcy and have one collection agency informing us that they plan to take legal action against us - if we file bankruptcy after they file suite - will we be able submit the collection agency on the bankruptcy?

Yes, the collection agency would be included in the banruptcy. Once the banrkuptcy is filed there is a stay against legal actions by creditors.
