Question:  

Upon separation my spouse waived all his rights to title on my house. We were listed as joint tenants and now it is in my name only. Here is my concern, we had the signatures to transfer title signed in August 05 but my lawyer was slow to file so the title is registered to me as of Oct 23/05. Unknown at the time my spouse declared bankruptcy on October 5/05. Will this effect me at all. His trustee wants me to send them a mortgage balance statement showing balance as of October 05. Should I provide this info...or do I have to?

Answer:  

If the Trustee is requesting a mortgage statement he is likely trying to determine the amount of equity in the home. It would be helpful for you to provide it otherwise the Trustee will have to contact your mortgage company. I can't answer the question about the transfer and suggest you talk to the Trustee on the file.
