Question:  

How many unsecured creditors would it take to petition the court for an involuntary bankruptcy in Alberta ? I am the principal in a company that has an outstanding amount owed to them by an Alberta corporation, and was wondering how difficult it would be to push the company into bankruptcy.

Answer:  

One or more creditors can file a petition if the debt owing is greater than $1,000 and an "act of bankruptcy" was committed in the last six months.

You should speak to your lawyer regarding your situation and if you need a Trustee to consent to act for your petition, please contact Bruce Alger (296-2970) of our office who can discuss this matter further with you.
