Question:   My husband and I declared bankruptcy last year. We has 4 job losses between us and couldn't manage. When we filed with the trustee we also filed a form to declare a disability for our disabled kids. Well it was approved by Revenue Canada and they went back over our income tax for the last 6 years and we got a refund of nearly $10,000. Or we would have except they sent it to the trustee. Can they legally seize this money? isn't it for my kids, who could use it for their school tuition and special programs? Can I appeal this?

I'd suggest you talk to your Trustee, the Office of the Superintendent of Bankruptcy (Industry Canada) or a lawyer for the advice you are seeking.
