Question:  

Tax returns - who does the refund go to? 1st year? Second? 3rd? how many returns must the trustee file?

Answer:  

Refunds for the tax years before the bankruptcy and the tax year in which a person files are considered to be assets of the estate. If there is a delay in the discharge, subsequent year refunds could also become assets of the estate.
