Question:   About 5 years ago, I paid an attorney $1,000, in Toronto, to begin bankruptcy papers. I moved to Montreal and lost touch with the attorney. I had to supply Revenue Canada with this information. I found the attorney, who had changed law firms, but he never returned any of my phone calls. Now, two years after that, I need to know if I am bankrupt or not. I do not think that I am. My financial situation is different now. Do I pursue my bankruptcy or make an offer to my creditors?

To find out if your bankruptcy was ever filed call Industry Canada at (613) 941-2863. They will need your birthdate, name and reason for the search. If you are in bankruptcy, you need to be discharged. Therefore, you must contact your Trustee (not attorney, as only a Trustee can file an assignment for an individual). If they will not help you, contact the local of the Superintendent of Bankruptcy or a lawyer to help you.
