Question:  

My husband and I have been married 2 yrs. He is considering filing for bankrupcy for debts incurred prior to our marriage, including back taxes. Will a bankrupcy filed this year cover back taxes dating to 1999-2002? Will I be responsible for any of the debts as they predate our marriage? Can he file for bankrupcy alone?

Answer:  

Tax debt for all years prior to the bankruptcy are covered. You are not responsible for any of your spouse's debts unless you co-signed for them. He can file for bankruptcy on his own.
