Question:   I have a Canada student loan. Half of it is still with the bank and the other half has gone to a collection agency. Can the half that has gone to the collection agency be used in a personal bankruptcy?

Answer:  

The collector of the loan is not the determinant of the forgiveness of the loan but rather the length of time since you left school. If you were in school in the last 10 years then the loan may survive bankruptcy. You should contact a Trustee in your area to attend a free assessment of your financial situation.
