Question:  

I have recently married a man that claimed bankruptcy with his first wife, 8 yrs ago.

He has just lost his job and we owe $66000.00 on the house, 22000.00 on a car, 17000.00 on a truck, 15000.00 on a holiday trailer, 24000.00 line of credit and some other bills.

My question is: Can we file for bankruptcy, even though he has filed once before with a different wife? Or can I file alone and on the things that are in both of our names?

Answer:  

Your husband could file for bankruptcy a second time. You could file alone or at the same time as your husband. If you file and he doesn't, he will still be liable for any debts in his name.
