I took out an Avco loan a year or two ago which was a
chattel mortgage. I've been unable to make payments recently because of a
job change, but unable to file bankruptcy at the present time because I am
wrapping up an incorporated company. Avco has obtained a judgement and a
wage garnish (garnished my wages with my company) which I have honored,
however with gaining new employment in a couple of days I am worried avco
will pursue my new employer and jeopardize my employment. I am planning on
meeting with a trustee within the next week to declare bankruptcy. Is there
anything I should do in the meantime to prevent Avco from contacting my new
employer? My new employer is the same company I used to contract to so they
know who it is. Because a judgement has been obtained will I still owe the
full amount after declaring bankruptcy or will I have to settle on this. I
don't care if they take the two items they have as security.

If you file bankruptcy, the judgement and garnishee will be stopped and will
not have to be paid. In the interim you can tell them you are seeing a
Trustee and that may give you some breathing room.
