Question:  

I am currently filing for divorce. I live in Edmonton, AB. I have 4 children under the age of 12. My husband and I have no assets and we have a 1999 van that has 13,000 owing but I need the vehicle for my work and to transport my 4 children. My husband has 2001 Dodge Ram Diesel owing 35,000 and a 2001 27 foot westwind 5th wheel owing 30,000. I have credits card owing 15,000. I have a 21,000 loan. I make 2200 a month and can not make the payments. I am currently living with my mom whose is downsizing because of costs and I will need to find a rental unit close to the school and close to childcare. I have been unable to contribute financially to additional expense my mom is having because of the additional 5 mouths to feed. My husband has verbally said he would pay 1200 childcare but at this point in time not happening.

Will I be able to keep my vehicle? A car cannot hold 4 children plus myself? What would the trustee payment be? My husband does not want to sell his vehicle and trailer. But I cannot make the payments. What happens to him if I declare bankrupcy? What are my options? What kind of rental housing can I look for for a family of 5 after declaring bankrupcy? What should I be budgeting for?

I am budgeting my monthly expenses as following

  • Rent 1000.00 (is this reasonable for 5 people?)
  • Groceries 600.00 including diapers
  • Utilities 600.00
  • Vehicle Maintenance and Gas 150.00
  • Clothing 200.00 month
  • Babysitting 350.00
  • School 169.00
  • Insurance car and tenant/property 325

Is this being realistic? What are my options?

You will be allowed to keep the vehicle if the secured creditor allows you to keep making payments. You would no longer be liable for payments on your husband's assets.
