Question:

If the husband files for bankruptcy, and he lives with his wife and dependent children, and the wife also works, is her income considered part of the husband's income? That is, would his wife be dragged into the proceedings also?

Answer:

Usually in a bankruptcy the entire family income is reported on the monthly Statements of Income and Expenses but there are exceptions when the spouse can be left out of the proceeding. Your Trustee will discuss with you how your unique situation is best handled.
