Question:  

I filed Chapter 13 in September of 2002 to bring me current on mortgage, car loan and other past due expenses. I was suppose to start paying my mortgage in October which is $636.56 and the agreed bankruptcy amount starting in November of $400.00 per month, which includes my car, but I was not able to find a job to support this amount. I am now behind again owing my mortgage for October, November, December and now January and I still owe the bankruptcy amount for November, December and January. My lawyer is no help and is simply saying that there is nothing that they can do. I am now employed as of December making $9.50 per hour and the job is stable. I am considering filing a Chapter 7 in which I will lose my home and my car and just start over. What should I do? If I file Chapter 7, can I still get the equity in my home since I have lived there since September,2001? Please let me know ASAP, running out of time ...
