My parents own a motorhome and an RV lot in B.C., but all of their mail and government documentation supports that my home is their address even though they live on this lot. We have 2 vehicles: a 1995 Ford Ranger, worth about $7-8000, which is free and clear and I am making payments on the other one - a Crysler - which is worth about $17,000 the same amount as what I owe on it (a loan, not a lease, due to the miles I put on it every year). We each need a vehicle to drive to work, because we live out of town. I read that in Alberta, we can keep a vehicle worth $5000. Now, I understand that it's between me and the loan company what happens to the Crysler, but will our truck get sold because it's worth more than the allotment, forcing us to but another cheaper one so my husband can get to work?

I took out an Avco loan a year or two ago which was a chattel mortgage. I've been unable to make payments recently because of a job change, but unable to file bankruptcy at the present time because I am wrapping up an incorporated company. Avco has obtained a judgement and a wage garnish (garnished my wages with my company) which I have honored, however with gaining new employment in a couple of days I am worried avco will pursue my new employer and jeopardize my employment. I am planning on meeting with a trustee within the next week to declare bankruptcy. Is there anything I should do in the meantime to prevent Avco from contacting my new employer? My new employer is the same company I used to contract to so they know who it is. Because a judgement has been obtained will I still owe the full amount after declaring bankruptcy or will I have to settle on this. I don't care if they take the two items they have as security.

I have talked to a lawyer about stopping this. It seems it will take somewhere between 20-50,000 to stop him, and then it may be too late as he is spending more and more, and not paying the bills. What choices do I have as far as claiming bankruptcy in the company instead?
It is a complicated case, as the company was in development stages,and was planning on having many avenues of business. We had an online store in progess. We had a team of web developers, and many jobs on the go, we ran an ISP ( Internet service provider, and had a WAN between towns for businesses.
The other shareholders has taken all the staff, jobs and is running them
out of a different company. So to bank rupt this company would not help to stop his theft. I can not afford the 20,000. But feel that he has done wrong and should be stopped.

I have been an American citizen all my life but have lived in Canada all my life. However, I am now leaving to live in the US and will be obtaining a social security number. My question to you is, what happens to my current credit file? If I apply for credit down in the States using a new social security number and a new address will I in fact be creating a new credit idenity for myself? Or is this even possible? My next question concerns a bankruptcy. I recieved a full discharge in August of 94. I live in BC where the bankruptcy was obtained. I had wondered when this will be removed from my credit file as their seems to be a lot of uncertainty even amongst banking professionals. My trustee had told me 6 and I had confirmed this with an Equifax telephone operator. According to them I should expect to see it off my file in

My wife had a credit card from work in the company name and her name. It cost us 15,000.00 for a loan to pay it off. The company gave her another one only after the credit card company made her sign saying she would use it for company use only . I owe the following: bank loan (joint with wife) 15000 secured by our vehicles, avco 2700 secured by a chattel on my personal property, 28000 in credit card debts. I cannot meet the monthly commitments on all of these debts. We require both vehicles and do not want to approach our bank about declaring bankruptcy in case they get cold feet and call the loan. I am considering bankruptcy in the very near future,
as my credit is beyond repair. My problem is this: I cannot open a bank account. I have been declined at three mayjor banks, after they do a routine credt check. My credit report indicates a R9 with just about every creditor. I cannot set-up auto deposit at my new job, which is a company policy. I have to pay my creditors, landlord and utility bills with money orders,costing $5.00 ea. I lose 40-$50.00 bi-weekly using near banks to cash my paycheque. I obtained credit with several companies four years ago when I had a good job. However, for the past two years I have been unable to meet any of these obligations, due to employment problems. My boyfriend lost his job due to his mother being ill and him needing to take her to the doctor or emergency room. He had no recourse but to file bankruptcy, chapter 7 back in september '99. Every time he turns around to look for a job his mother gets sick. His student loan was not discharged because he went into repayment in 1994. This problem with his mother began in 1992. He has been unable to hold a job, because of her. The student

I was repaying my debts through Alberta Credit Counselling, but during this I became single and couldn't keep up. This led to missed payments and me finally being kicked of the orderly repayment plan. What can I do now? What happens if you are barely getting by month after month and cannot even afford the Trustee's fees? I've heard that if one can get two trustees to deny you as you can't afford to pay that you can still go bankrupt and not have to pay. If this is true, how does it work? My question is, can bankruptcy payments be lowered after we agreed to pay the amount stated? Also my landlord is threatening to cut off our water supply. Can he do this?

In a case where one has accumulated bills beyond the ability to pay them off, or even make all the minimums, and being off
work for medical and stress leave, what are the alternatives? The stress of
dealing with the debt is causing more health problems, so it seems like a
vicious circle. What do you recommend?

My husband and I are considering filing for joint bankruptcy. Our house has been assessed at $139,500 by the City for tax purposes. Our morgage is $95,000. Making the equity in the home $44,500. I understand that in Alberta the exemption is $40,000. Will this mean we would lose our home?
