Question:   My husband and I filed for bankrupcy in January 2003. Before we filed my husband was working, but became ill. He had to go on medical leave and is currently receiving Unemployment benefits. I on the other had am not working as of yet. I am a stay home mom and am looking to work out of the home. Our debt was in excess of $80,000.00, which accumulated over the last 12 years. My husband is thinking of working for himself, but we are unsure how this will affect our bankrupcy. We were told that we had to file a tax return at the time of discharge which is in mid October. How do we claim his income? (net or gross? and When filing the return, what sort of document will we need? Your immediate response would be greatly appreciated. Thank you.

Answer:   There is a tax return filed at the date of bankruptcy (pre) and at December 31 of the year you file. Your Trustee can advise you of the procedure they use and I'd suggest you ask them.
