Question:  

I understand that the trustee will take my GST refunds for my creditors during the bankruptcy period, but what about my Child Tax credit? Will they take that money also? If not, what if I am owed a large amount by the gov't in back Child tax due to being late filing my taxes? I will owe no tax once I file, so expect about a year's worth of Child Tax credit & GST refund. Will they take both refunds?

Answer:  

The Trustee cannot take your child tax benefit, only your GST refunds. If you have large refunds coming you must report the child tax amount received to your Trustee but the GST refund should be sent directly to the Trustee.
