Question:   We took our bankruptcy out over 11 months because we were unable to afford the payments over nine months. We have now come into some money from a personal injury settlement. Would we be able to pay it out early and be discharged within the 9 months?

Answer:  

If you are able to pay your fee early, there should be no reason why you can't obtain the automatic discharge, as long as you have done all of your other duties and there are no objections.

However, your Trustee may have an interest in your settlement depending on whether it is all pain and suffering or if there is some asset or income component. You should contact your Trustee so this can be worked out.
