Question:  

I filed bankruptcy in 1995 before I was married. I married 5 years ago, and my husband and I are in trouble with money. Before I was married I had started rebuilding my credit so I had 2 credit cards that were in my name. My question is, since I have already filed, I know I cannot file again for 10 yrs, but can my husband file? Can the cards that are still in my name be put over onto his claim?

Answer:   There is no limitation on the time that must elapse between a first and second bankruptcy - you are not required to wait ten years if you feel you need to file again. If only your husband files for bankruptcy, he must include all debts for which he is responsible and you will still liable for any debts in your own name.
