Question:  

I have been with my boyfriend now for 2 years. Currently before I had met him he had added his ex-girlfriends name to his credit cards to gain her credit in the future.. Altho he says that she never used the cards herself, the cards and credit accumulated to almost a 30,000 dollar high. He now is in debt over these cards and she is gone. Bankruptcy seems like the only way for him to go now, but he refuses to claim because it will ruin her credit also. This is hurting our relationship now because he will not take the measures he needs to stay in tact with everyday needs.

So please tell me if he files and her name was added to the cards, which he said she never used, how much will she have to be involved with this whole mess??? I do have a feeling even though he denies her ever using the cards that she is somewhat to blame for this debt. Will she have to be at court with him etc.. etc...???? Please help me with this mess if you can.

P.S. Is there a way to tell which one of them spent the most on creating this debt by retaining records and so on?

Answer:  

Normally if another persons name is on the card they have accepted responsibility for the whole debt. If your boyfriend files bankruptcy then they could proceed after her for payment.

To see if she is responsible, I would suggest he call the card companies and see if they feel she is. Sometimes if the person never used the cards, they can't be held responsible. Ask the card company for proof that she is responsible by producing some documentation with her signature.
