Question:  

My wife and I are considering bankrupcy.

  1. Are my Revenue Canada owed taxes (payroll)included as debts in the bankruptcy?

  2. My wages are currently garnished by the Alberta government for child support (I'm all paid up and current however they feel it easier to do it this way). And sometimes my employer misses sending their payment and MEP garnishes me up to 70%.

  3. Do/can we include my wife's student loan dating back to 1989? I hear mixed answers since the loan was from so long ago.

Answer:  

Any debt to Revenue Canada is included in a bankruptcy. Maintenance enforcement can continue to garnishee even during a bankruptcy. I would try to ensure your employer pays this on time so you don't have any surprises.

If your wife left school over ten years ago her student loan would be included and discharged in a bankruptcy.
