Question:   My boyfriend is newly divorced and might declare bankruptcy, as his ex-wife racked up a lot of bills under his name. Is she responsible for these bills in whole or in part, even if her name isn't on them?

Answer:  

A second person is can be held responsible for the debt in a couple of different ways:

  • if they signed or cosigned the loan document
  • if they guaranteed the debt for someone else.
  • if they signed for a second credit card
  • if a second credit card was sent in their name and they started using it
  • if they have a joint bank account and it is in overdraft

If your boyfriend files bankruptcy, this will stop the collection against him. If his ex-wife is responsible for the debt, they can proceed after her.

He should contact a Trustee in your area by looking in the yellow pages under "Bankruptcy" to obtain a free assessment of his financial situation.
