Question:  

I have been living in Alberta for the last 8 years, during which I have accumulated approximately 20,000 in debt. Because I can no longer pay even the minimum payments or even pay rent, I have decided to move back to Ontario with my parents. I was going to file an OPD but my father said it would be in my best interest to file for bankruptcy (as I can not afford to even pay the OPD payments) It is now August and I am moving to Ontario in September, all my debts are in Alberta ... where should I file? If I file now in Alberta will I be able to be on my way by mid September? Please help, I need to figure this out soon.

Answer:   If you choose to file in Alberta you can still move to Ontario in September. Because your duties in a bankruptcy require you to attend for counselling and potentially attend in Court, however, you may want to wait until you are living in Ontario before you file. One factor that may affect your decision is the assets that you have and the exemptions that apply in each province.
