Question:

I am now an undischarged bankrupt. I have the possibility of working in Kuwait during the latter part of the 9 months.

  1. Is this possible? If I want to sell my house here in Canada to buy one there, are the proceeds still exempt as they were at the onset of this bankruptcy?

  2. Do both myself and my husband have to go to Kuwait or does he have to remain here if we are unable to sell our home (less than 40K equity in Alberta)? We are quite confused as to how or if this relocation can occur. Please help!

Answer:

Once you file bankruptcy you can go any where in the world you wish as long as you maintain contact with the Trustee and complete all the duties in order for you to obtain your discharge.

With respect to your personal residence, exemptions are looked reviewed the date of bankruptcy and supposedly what you with them afterwards is up to you. however, case law on this can change and I would suggest you talk to your Trustee regarding this and as well you may wish to obtain an opinion of legal counsel if you are not sure.
