Question:  

My husband declared bankruptcy in 1995, before we met. He made the payments and received a letter explaining his discharge at the end of 9 months, early 1996. He took this to mean he was discharged and not knowing any better, moved on. We got married and moved to Ontario in 1997. We recently did a check on our credit reports and have found out that he is not discharged, due to a creditor contesting. Looking into it, we have found out that he would owe what seems like an arbitrary number the trustee chooses. He claimed for only $1500, but it looks like he may have to pay up to $1000 to get it discharged. If he has already made the monthly payments, what can we do to get rid of this without starting over?

Your husband will need to either deal with his Trustee to complete the bankruptcy or hire a lawyer to make the necessary Court applications.
