Question:   Could you tell me if Student Loans can be included in the filing of Bankruptcy and what about credit cards, would I lose them?

Answer:

If a person has left school within the last 10 years, their student loan will survive a bankruptcy. There is a stay against collection during the bankruptcy process but interest continues to accrue.

With respect to the credit cards, you must turn them over to the Trustee to be sent back to the companies.
