Question:  

I have a friend in Alberta who has been separated from his wife for over a year, but is not divorced. If she files for personal bankruptcy, can they go after him for payment? Does it depend on whether the debts were incurred while they were together or since they've been apart? Does it matter whether the debts are just in her name? Can this affect his credit rating in any way?

Answer:   Creditors can only pursue someone for debts they have signed for. If your friend did not co-sign for his ex-wife's debts then creditors cannot collect from him. Being married to, or separated from, someone does not make you liable for their debts. Credit records should remain separate as well.
