Question:   I am doing a project on bankruptcy and I have found plenty of information dealing with the topic but nothing concerning the consequences of not abiding by the Bankruptcy and Insolvency Act. I was looking for examples as to what would happen to an individual that does not abide by the Act?

Answer:  

If an individual does not comply with their duties, the Trustee will object to their discharge and proceed to court. The court can grant a discharge conditional upon the individual completing the duties. There are sometimes financial or time penalties for non-compliance. If the individual still does not comply then their discharge can be adjourned and they remain in bankruptcy. Their pre-bankruptcy creditors can then pursue them again.
