Question:   Hello, My husband and I were on the verge of declaring bankruptcy (within the next couple of weeks) and his mother has just died. He will likely inherit some money from the sale of the apartment, but that could take over a year and we will not survive in the meantime. Will we have to turn over the money if it is received 12-15 months from now? Will the creditors refuse discharge if they know this money might be coming? Thanks.

Answer:  

The pending inheritance is an asset that must be declared to the Trustee and recovered for the creditors. If it is not received before the discharge date, your discharge could be delayed. Your Trustee will be able to advise you once he/she knows the details of the inheritance.
