hi my husband and i are contemplating filing for bankruptcy.a few quick question we owe over 90,000 in card debts as my husband was injured at work and has been unable to work since 2002. we have not made a payment on the card and are taped out each month my husband get s465. per month wcb and i make net 1500 per month. i have just been informed by one of my creditores that they are going to take my wages from my work. we have 2 children living at home 1 just turned 18 the other is 19 and my husband who is stil waiting for surgery . how much can they take each month as we cant get by now and it will be even harder with less. here in the bad part we had a buisness in sask back in the 80 and it went broke and we had to go into bankrupt and again in the 1990 same thing buissness went broke and had to go in alberta. those were instances of a bad financial buissness. this one we had no controll as it was a work injury that has forced my husband from working will this make a difference also to add to this my husband was in a motor vehical accident and was injured. if we filed would this now be handled without our imput and would we lose anything that came from the accident. we are just at a losse of what to do we seen a trusty here in med hat but he wants 2000 up front and we have no way of getting this money. help

Answer:

 

The exemption from wage seizure in Alberta is $800 plus $200 per dependent per month. AS for you declaring bankruptcy a third time, it is possible but it would be difficult for you to be discharged. I expect that most trustees would want a fee deposit and you could expect to be in bankruptcy for sometime and pay further amounts to get out. Of course, the on mitigating factor is that your financial difficulties are caused by a much different reason this time.
