Question:

My boyfriend and I recently got engaged. He declared bankruptcy in August. I am a single parent with 2 childern and a home and all of the associated expenses . We decided to sign a prenup to ensure that my home as well as property and debt remains mine and vice versa. Once we marry, does my income, assets etc have any impact on the bankruptcy? Or does the prenup protect against this?

Answer:

It is actually not even necessary to have a prenuptial agreement to protect your assets in a bankruptcy of a spouse. What is yours is yours and your income cannot be taken by a trustee of your spouse.
