Question:

 

My ex-husband filed bankruptcy 1 year ago. We have been divorced for about 1 year. He never told me that he filed and now, when I pull down my credit report, it reflects the bankruptcy he filed. It is bringing dowm my credit, because he never paid his bills. I now have creditors coming after me for bills he incurred??? Am I liable for his bills? Do I have any rights or must I file bankruptcy to get out of this matter? It's an issue I want to avoid because I believe in paying my bills, but why would I be responsible for bils he incurred? We have been separated since 1999!

Answer:

 

You are not liable for the debts of a spouse. What has likely happened is that you have had credit cards as a secondary cardholder. If this is the case, you are jointly and severally liable for this debt. You should contact the creditors and determine what you have signed and why they think you have a responsibility to pay this debt. Good luck.
