Question:

My mother passed away recently. She was in the process of making monthly payments to discharge her bankruptcy. She passed away before she had finished making the entire payment. The company she was making these payments to now wants all of the money that was initially covered in the bankruptcy, plus they want to collect their legal fees from the estate. They claim they can get this money because the situation has now changed as there is money in the estate that was not present when my mother was alive. Can they do this? Should the estate hire a lawyer to fight this? If the estate does hire a lawyer to fight this (especially to fight the collection of their legal costs) does it stand much of a chance of winning?

I'd suggest you talk to a lawyer who specializes in bankruptcy about this matter.
