Question:

 

I am a single mother of 2 making less than $30,000 a year gross. I am currently in litigation with my ex-husband for child support - can the child support I receive be garnisheed/taken by a credit company for a vehicle purchased in a previous relationship (NOT my ex husband, I never used the vehicle, co-signed using my good credit, broke up shortly after purchase and primary owner makes more than twice my income) - am concerned that my child support is at risk of being taken. I live in Alberta. Any advice would be greatly appreciated! Thank you.

Answer:

 

I don't believe a creditor can attach to maintenance directly, but if the funds are deposited into a bank account they could be seized from there.
