Question:

My husband I are going through a trial seperation. Money is the number one problem affecting our marriage. My husband has filed a voluntary disclosure for unfile taxes. He owes a lot of money. Can he file for BR if he can't pay it back to the tax dept? Will I still be considered joint with him when they do the surplus income payment?

Answer:

Yes, if your husband cannot handle his tax and other liabilities, bankruptcy is one option that is available to him. In answer to your other question, if you are living separate and apart, he would be considered single person for the purposes of a bankruptcy.
