Question:

I have not been able to work since April due to illness. I have about $5000 worth of debt. I was making my payments up until then. Now they are calling me for their money. I get $767.00 a month cpp disability and $243.00 child tax credit. I also get 143.00 every three months GST credit.I have looked into claming bankruptcy but can not even afford the payments for that. I am a single parent of a 12 year old and i have no assets, no rrsp's, I rent my home and have less than $4000 in household goods. I would like to know if they got a judgement against me would they be able to take my cpp and child tax credit out of my bank account even if I change banks? I know that in general they can garnishee bank accounts but I was wondering if I would be exempt because of my situation.

Answer:

This income would be exempt from seizure. I suggest that you write and tell them what your situation is and that you will get back to your creditors if things improve.
