Question:

 

My husband filed for bankruptcy on his business which meant personal also. He has previously filed and been discharged but this is his nd time. We have rec. a back pay of child tax for 2002 and 2003. Will the government take that or also will 1/2 be taken cause the income will be over the set amount monthly. The tax comes in my name. Thanks, Debbie.

Answer:

 

If the Child Tax Benefit is yours then the government shouldn't take it if your husband is bankrupt. You will be required to declare the payment to the Trustee but the surplus income calculation shouldn't take 1/2 if you are not bankrupt. Your Trustee can explain how the calculation works.
