Question:

 

I used to live in montreal until 2007 where I moved to Iran. I have student loans as well as credit card debts in my name. My last home address in montreal is my brother's address and he has been recently receiving letter from debt collectors threatening to go to court. What can I do if they do a court summon I am not coming to montreal for at least a year?

Answer:

 

Obviously you cannot attend court from another country. You can respond in writing but the only defence is that you don't owe the debt and that's not the case. If a judgement is ordered against you, a creditor can only collect on the judgement if you are resident in Canada so upon returning to this country you may need to seek professional advice from a Trustee.
