Question:

 

How many Income Tax refunds does the bunkruptcy trustee keep. If I declared bankruptcy in 2008, receive my t4 in Feb 2009, the trustee files this return. What about the t4 i receive in Feb 2010 for the 2009 tax year? Is this refund mine? Also, when do I start getting GST checks again?

Answer:

 

The Trustee is required to file any outstanding tax returns for the year prior to your bankruptcy and the return for the year of your bankruptcy - so in your case 2007 and 2008. If you received a discharge then you would proceed to file your 2009 tax return. GST checks will flow to you again when the Trustee is discharged.
