Question:

 

Recently learned that a disability pension we recieved was overpaid due to my spouse working-they are demanding we pay the overpayment back - due to our limited income now with only my spouse working can we declare bankruptcy against a government debt such as the above? Also if we had a previous bankruptcy but were only partial discharge do we have to redeclare bankruptcy to clear the previous partial discharge?

Answer:

 

You cannot file a second bankruptcy unless you are discharged from the first. Revenue Canada debt is dischargeable.
